How to Legalize Minnesota Documents for International Use

An apostillé issued by the Minnesota Secretary of State certifies the authenticity of public documents so they can be recognized abroad in countries that are members of the 1961 Hague Apostille Convention.

 

Crucial Note for Minnesota: Minnesota's process is direct. The Minnesota Secretary of State does not require a mandatory intermediate step—such as authentication by a County Clerk—for documents signed by a Minnesota notary public or a certified state/county official. You submit the document directly to the office for the apostillé.

 

Processing Time: for mail-in requests, the typical turnaround time is 2 business days after receipt. Online orders for a Certificate of Statususually result in the resulting Apostille being emailed within 10-15 minutes after payment.

 

Corporate Records

  • Documents: Articles of Incorporation, Articles of Organization, Certificate of Status (Minnesota's name for a Certificate of Good Standing/Existence), and other official corporate filings.

  • Requirement: These must be certified copies obtained from the Minnesota Secretary of State, Business Services via a copy request. No additional certification is needed.

  • Internal Documents (Minutes, Bylaws, Corporate Resolutions, etc.): These documents must be notarized by a Minnesota Notary Public who completes the proper notarial certificate (Jurat or Acknowledgment). No County Clerk certification is required.

Real Property Deed or Records:

  • Documents: Deeds or other instruments relating to real property.

  • Requirement: Must be a certified copy obtained from the County Recorder or Registrar of Titles in the county where the property is located. No other certification is needed.

Vital Records (Birth Certificates, Marriage Certificates, Death Certificates, Divorce Decrees (or Judgment and Decree).

  • Requirement:

    • Birth, Marriage, Death Certificates: Must be a certified copy signed by a local (City/County) or State Registrar from the Minnesota Department of Health, Office of Vital Records.

    • Divorce Decrees: Must be a certified copy obtained from the District Court Clerk in the county where the divorce was filed.

  • Note: No County Clerk step or Letter of Exemplification is required.


Academic / Notarized Documents (Diplomas, Transcripts, Power of Attorney, Affidavits, etc.):

  • Requirement: These documents must be notarized by a Minnesota Notary Public. The notary must complete a proper notarial certificate (Jurat or Certificate of Acknowledgment) to make the document eligible. The notary's signature does not need to be certified by a County Clerk. Simple attachment of a notary stamp is insufficient; the notary must complete the required notarial language.

If a foreign authority specifically requests a document detailing the company's complete filing history (such as amendments, mergers, or name changes), the history is obtained separately via certified copies of the specific records on file from the Minnesota Secretary of State.

 

2. CONSTITUTIONAL (FORMATION) DOCUMENTS. These are public records available:

  • For Corporations: Articles of Incorporation

  • For Limited Liability Companies (LLCs): Articles of Organization
